City of Brampton Racquetball Association
Bylaws (2003)
Article 1: Office
Section 1. The permanent office of the Association shall be at
such a location as may be selected by the Executive Committee (hereafter
referred to as the Board).
Article II: Members and Memberships
Section 1: Membership shall be offered to all residents of Brampton
and surrounding community age 18 or older. Membership will be first offered
to residents of Brampton and, if necessary to fill specific positions
on teams or team levels, will be offered to residents of surrounding communities.
Section 2: The secretary will post or cause to be posted at each
City racquetball facility an up-to-date roster of all members.
Section 3: Any member, pursuant to written notice and hearing
(conducted by the Board), may be suspended or expelled from membership.
Such a suspension shall be reported in writing, stating the details and
cause for suspension or expulsion. Cause for suspension or expulsion shall
be a violation of the Bylaws or Rules of the Association.
Section 4: CBRA Memberships shall be transferable. In the case
of a member moving out of the area or an injury, the membership may be
transferred to a new member subject to the approval of the Board.
Article III Membership Privileges
Section 1. All active members in good standing shall be accorded
equal privileges in the use of facilities and shall be subject to the
same rules and regulations, which shall be conspicuously posted on the
Association premises.
Section 2. Only active and spare members in good standing shall
be accorded the privileges of the Association, except, that members of
the Board may extend the privileges of the Association to any person(s)
upon such terms as it shall fix.
Section 3. Provisions of the rules and regulations may be waived
for specific occasions by a majority vote of the Board.
Article IV Membership Fees, Annual Dues and Assessments
Section 1. The selling price of Membership owned by the Association
shall be determined once annually by the Board.
Section 2. Annual dues shall be sufficient to provide for the
expense of operation and maintenance of the Association, and shall be
payable each year by the membership prior to the ensuing league season.
Section 3. The Board shall fix the amount of the annual dues
by August 1 for the ensuing year, based on anticipated operation and maintenance
expenses.
Section 4. No portion of the dues shall be refunded or remitted,
except for death, expulsion or resignation, in which case the prorated
unused portion shall be refunded after all obligations to the Association
incurred by the membership are discharged, including the return of team
shirts.
Section 5. All Members who are delinquent in payment of its dues
shall be prohibited from participating in the Association.
Article V Membership Meetings
Section 1. At a date and time to be fixed by the Board in the
month of April or May each year, the Association shall hold its Annual
Membership Meeting for the purpose of electing the Board, receiving the
reports of officers, approving the budget for the next league year, and
for such other business as may come before it.
Section 2. Special meetings may be properly called by the Board
assuring that all members are notified. Special meetings may also be called
upon the request in writing of ten (10) active members filed with the
secretary, who shall call said meeting within thirty days after the time
of filing the request.
Section 3. “Proper Calling” requires notice of meeting
to be mailed, Emailed, delivered or posted on the website or at the courts
to the membership at least ten days prior to the date of the meeting.
If an annual meeting, the notice shall include all the names of candidates
nominated, the proposed budget, and other business matters planned to
be acted upon. However, nothing herein prevents new business matter to
be brought up by members at any meeting. If mailed or Emailed, notices
will be sent to the last known address of members.
Section 4. Only active members in good standing may vote. Active
members may vote by written proxy filed with the Secretary three days
before the meeting or by a designated active member as an alternate.
Section 5. The form of voting (open or secret) shall be determined
by the President subject to the approval of those present at the meeting.
Section 6. No quorum shall be required at Membership meetings.
Approval or disapproval of actions and elections shall be made by those
active members present (or by proxy or designated alternates). Majority
vote rules except when otherwise indicated.
Section 7. Actions taken at such properly called meetings shall
be binding on all members.
Article VI Officers
Section 1. The officers consist of President, Vice-president,
Secretary and Treasurer, who shall be elected at the Annual Meeting of
the Membership for a term of one year, or until their successors are elected.
Section 2. The President shall preside at all meetings of the
Board. The president shall be the administrative officer of the Association.
Section 3. The Vice-President shall serve in the absence of disability
of the President.
Section 4. The Secretary shall keep the minutes, attend to the
correspondence, send all notices of meetings, see the Board operate in
according to the Bylaws and Constitution. The Secretary shall maintain
up-to-date copies of the Bylaw, Constitution and Canadian racquetball
rules.
Section 5. The Treasurer shall have charge of the moneys and
books of account, shall pay all bills.
Section 6. The term of office shall begin on the first Board
meeting after the General Membership Meeting.
Section 7. Cheques to disburse the funds of the Association will
contain the names of two officers of the Association.
Article VIII Duties of the Executive Board
Section 1. Conduct the affairs of the Association, taking such
actions as may be necessary, within the established limitations, to carry
out the purposes of the Association.
Section 2. Exercise one vote each, Board members and officers
alike, including the President.
Section 3. Place members in teams, balanced in skill levels,
to the best of the Boards ability.
Section 4. Prepare team rosters, league schedules, and maintain
or cause to be maintained league statistics.
Section 5. Arrange for all league shirts.
Section 6. Arrange for and coordinate all social activities including
the end-of-year banquet.
Section 7. Arrange for any league sponsorships.
Section 8. Coordinate, print and mail any league information
as needed.
Section 9. Prepare an annual budget for the Board and supervise
all financial transactions.
Section 10. Seek new members and maintain an up-to-date roster
of active members.
Section 11. Provide a liaison with the City of Brampton.
Section 12. Prepare and maintain the rules and regulations of
the Association.
Article XI Amendment of Bylaws
Section 1. These bylaws may be amended by a majority vote of
the active members present and voting at a properly called meeting or
by the Board.
